Acceptance of Terms

By accessing and using FXRM's services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these terms, you should not use our services.

Service Description

FXRM provides web hosting, email hosting, domain registration, and related services. We reserve the right to modify, suspend, or discontinue any aspect of our services at any time.

2.1 Service Availability

While we strive for 99.999% uptime, we cannot guarantee uninterrupted service. Scheduled maintenance and unforeseen circumstances may result in temporary service disruptions.

Account Registration

To use our services, you must:

Provide accurate and complete registration information
Maintain the security of your account credentials
Be at least 18 years of age or have parental consent
Notify us immediately of any unauthorized use of your account

Acceptable Use Policy

You agree not to use our services for:

Illegal activities or content that violates applicable laws
Distributing malware, viruses, or harmful code
Sending spam or unsolicited bulk email
Hosting phishing sites or engaging in fraudulent activities
Activities that compromise network security
Content that infringes on intellectual property rights
Adult content, hate speech, or harassment

4.1 Resource Usage

Shared hosting accounts must not consume excessive server resources. We reserve the right to suspend accounts that negatively impact server performance.

Payment Terms

All services are billed according to the plan selected. Payment terms include:

Fees are due in advance for the selected billing period
Automatic renewal unless cancelled before renewal date
Late payments may result in service suspension
30-day money back guarantee on new hosting accounts (see below)

30-Day Money Back Guarantee

We offer a 30-day money back guarantee on all new hosting accounts. If you are not completely satisfied with our services within the first 30 days of your initial purchase, you may request a full refund.

This guarantee is subject to the following conditions:

Applies only to new accounts, not renewals or upgrades
Domain registration fees are non-refundable
Setup fees and add-on services are non-refundable
Refund requests must be submitted via support ticket within 30 days of purchase
Accounts terminated for Terms of Service violations are not eligible
Refunds are processed within 7-10 business days to the original payment method

Data Backup and Security

While we implement regular backup procedures, you are responsible for maintaining your own backups. FXRM is not liable for data loss under any circumstances.

Domain Registration

Domain registration services are subject to the policies of the respective domain registrars. You are responsible for:

Ensuring domain contact information is accurate and current
Renewing domains before expiration
Understanding that domain transfers may take 5-7 days
Complying with ICANN policies and registrar requirements

7.1 Registry Terms and Conditions

By registering a domain name through FXRM, you agree to be bound by the terms and conditions of the relevant registry operator, in addition to these Terms of Service:

.uk domains: Subject to Nominet's Terms and Conditions of Domain Name Registration
gTLD domains (.com, .net, etc.): Subject to ICANN's Registrant Rights and Responsibilities and the applicable registry agreement

7.2 Domain Pricing

Domain registration and renewal prices are displayed on our website and within your client account. We will notify you of any price changes at least 30 days in advance. Pricing may vary by domain extension (TLD) and registration period.

7.3 Domain Transfers

Inbound and outbound domain transfers are free of charge. We will not obstruct or unreasonably delay any transfer request. Transfer processing times are subject to the policies of the relevant registry operator and typically take 5-7 days for gTLD domains.

7.4 Contract Termination

You may cancel your domain registration services at any time via your client account or by contacting our support team. There are no early termination fees. Domains remain active until the end of the paid registration period. Domain registration fees are non-refundable.

7.5 Renewal Notices

We send email renewal notifications at 90 days, 60 days, and 30 days before a domain's expiry date. It is your responsibility to ensure that your contact email address is accurate and that our notifications are not filtered by spam filters.

7.6 Expired Domains

If a domain is not renewed before its expiry date, the following applies:

The domain enters a grace period as determined by the relevant registry operator (for example, Nominet provides a 90-day grace period for .uk domains)
During the grace period, you may renew the domain at the standard renewal price
Services associated with the domain (such as email and web hosting) may be suspended during this period
After the grace period expires, the domain is released back to the registry and may become available for public registration by third parties

7.7 Auto-Renewal

If auto-renewal is enabled on your account, domains will be renewed automatically before their expiry date at the current renewal price. You may enable or disable auto-renewal at any time through your client account.

Intellectual Property

All content, trademarks, and intellectual property on FXRM's website and services remain the property of FXRM. You retain ownership of content you upload to our services.

Limitation of Liability

FXRM shall not be liable for:

Indirect, incidental, or consequential damages
Loss of profits, data, or business opportunities
Damages exceeding the amount paid for services in the past 12 months
Issues caused by third-party services or software

Service Suspension and Termination

We reserve the right to suspend or terminate services for:

Violation of these Terms of Service
Non-payment of fees
Fraudulent or illegal activity
Upon your request for cancellation

10.1 Account Cancellation

You may cancel your account at any time through your client portal. Cancellations made outside of the 30-day money back guarantee window do not entitle you to refunds for unused service periods.

Privacy Policy

Your use of our services is also governed by our Privacy Policy. We collect and process personal data in accordance with applicable privacy laws.

Support Services

Technical support is provided on a best-effort basis. Support response times vary by plan level. We do not guarantee resolution of all technical issues.

Modifications to Terms

FXRM reserves the right to modify these terms at any time. Changes will be effective upon posting to our website. Continued use of services constitutes acceptance of modified terms.

Governing Law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Indemnification

You agree to indemnify and hold FXRM harmless from any claims, losses, or damages arising from your use of our services or violation of these terms.

Force Majeure

FXRM shall not be liable for any failure to perform due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, riots, or failures of telecommunications infrastructure.

Severability

If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

Affiliate Programme

FXRM offers an affiliate programme that allows you to earn commissions by referring new customers to our services. By participating in our affiliate programme, you agree to the following terms:

18.1 Programme Eligibility

To participate in our affiliate programme, you must:

Have an active FXRM account in good standing
Be at least 18 years of age
Comply with all applicable laws and regulations in your jurisdiction
Not be a resident of a country subject to trade sanctions

18.2 Commission Structure

Affiliates earn a percentage commission on qualifying purchases made by referred customers
Commission rates are set at FXRM's discretion and may vary by product or service
Referral tracking is maintained via cookies for 90 days from the initial click
Commissions are only payable on new customer orders, not renewals or existing accounts

18.3 Payment Terms

Minimum payout threshold of £50 must be reached before commission can be withdrawn
Commissions are held for 45 days after the referred purchase to allow for refund periods
Payments are made via bank transfer or account credit at your preference
Affiliates are responsible for any applicable taxes on commission earnings

18.4 Prohibited Activities

The following activities are strictly prohibited and may result in immediate termination from the affiliate programme and forfeiture of commissions:

Self-referrals or referring your own accounts
Using spam, unsolicited emails, or deceptive advertising practices
Bidding on FXRM brand terms in paid search advertising
Cookie stuffing, forced clicks, or any form of click fraud
Misrepresenting FXRM services, pricing, or terms
Using coupon or discount codes not officially provided by FXRM
Promoting FXRM on websites containing illegal, adult, or hateful content

18.5 Trademark Usage

Limited licence to use FXRM trademarks solely for affiliate marketing purposes
Use only official logos and marketing materials provided by FXRM
Do not modify, alter, or create derivative works from FXRM branding
Do not register domain names containing FXRM trademarks

18.6 Programme Changes and Termination

FXRM reserves the right to modify commission rates, terms, or discontinue the programme at any time with 30 days notice
Either party may terminate the affiliate relationship at any time for any reason
Upon termination, earned commissions above the minimum threshold will be paid within 60 days
Commissions below the minimum threshold at termination will be forfeited

18.7 Disclosure Requirements

Affiliates must clearly disclose their affiliate relationship with FXRM in compliance with the Advertising Standards Authority (ASA) guidelines and any applicable consumer protection regulations. This includes using appropriate disclosures such as "affiliate link" or "ad" when promoting FXRM services.
